Regulatory & Compliance
- Managing environmental compliance audits for manufacturing and industrial clients focused on (among other things) the Clean Water Act, Clean Air Act, Toxics Release Inventory, and state law compliance.
- Representing potentially responsible parties at Superfund sites across the country in connection with ongoing monitoring, remediation, steering, and allocation efforts.
- Advising private and public clients (including manufacturing companies, drinking water utilities, and wastewater utilities) on strategic sampling, analysis, and diligence efforts aimed at proactively identifying, addressing, and minimizing risks presented by emerging contaminants, such as PFAS and 1,4-dioxane.
- Counseling manufacturing and industrial clients on federal, state, and permit reporting and response obligations following spills, fires, and other emergency events.
- Managing complex groundwater contamination cases, including by overseeing public relations support, environmental consultants, and relevant employees to minimize exposure and potential claims.
- Counseling entities in the trucking, transportation, and mobility space on compliance with emerging EPA and CARB regulations.
Litigation & Enforcement
- Litigating complex environmental disputes in federal and state courts and before administrative bodies, including actions under CERCLA, RCRA, the Clean Water Act, and state law.
- Representing manufacturing and industrial clients in connection with notices of violation, enforcement actions, and permit appeals under a wide variety of environmental laws.
- Negotiating beneficial settlement agreements/consent decrees with EPA and state agencies and assisting clients with ongoing compliance obligations arising thereunder.
- Managing complex matters involving vapor intrusion allegations, including agency negotiations, resident outreach, and consultant oversight.
Transactional Matters
- Representing buyers and sellers in real estate transactions with material environmental considerations.
- Coordinating with environmental consultants on meaningful diligence efforts, including Phase Is, Phase IIs, and other environmental protections.
- Analyzing and minimizing transaction-related risks through tools such as the BFPP defense, the innocent landowner defense, and other environmental protections.
- Negotiating appropriate environmental protections into transaction documents for manufacturing, industrial, and other clients.
