Focus Areas

Christopher has served as lead counsel in more than 150 cases involving patents, trade secrets and other intellectual property disputes, many of which have settled on confidential terms. Some illustrative examples of his experience include:

  • Obtained an eight-figure judgment on behalf of software publisher 4DD Holdings – a veteran-owned developer of complex data federation software – following a multi-week trial against the U.S. government in the U.S. Court of Federal Claims. 4DD Holdings LLC v. United States
  • Represented defendant Xylem Dewatering Solutions in a trade secret suit relating to wireless remote monitoring controllers. Successfully opposed the plaintiff’s motion for a preliminary injunction and compelled arbitration. The case settled on confidential terms following successful appeal before the U.S. Court of Appeals for the Third Circuit confirming the parties’ arbitration obligations. Field Intelligence, Inc. v. Xylem Dewatering Solutions, Inc.
  • Represented defendants Erie Custom Computer Applications and Payroll World in a nine-figure software dispute involving claims of copyright infringement, trade secret misappropriation, tortious interference with prospective economic advantage, and breach of contract. Obtained a complete defense verdict in a jury trial leading to dismissal of all claims. MPAY Inc. v. Erie Custom Computer Applications, Inc.
  • Represented a leading provider of direct marketing services in a trade secret suit against former executives and their new employer. Case settled on confidential terms after a hearing on cross-motions for summary judgment. IWCO Direct Holdings Inc. v. Nahan Printing, Inc.
  • Represented defendant Orthocore Medical, Inc. and its corporate parent, Caerus Corporation, in a multi-patent infringement suit related to pulse electromagnetic field technology in medical and veterinary devices. Following early motion practice, successfully obtained dismissal of two of three defendants. Following the court’s claim construction, obtained dismissal of all claims with prejudice and without payment of any settlement amount. Endonovo Therapeutics, Inc. v. Orthocore Medical, Inc.
  • Represented telecommunications equipment supplier PCT in a patent infringement case against competitor Holland Electronics, a division of Amphenol Corporation. Following a four-week trial in the District of Arizona, the jury found that 60 separate Holland products infringed PCT’s patent and rejected Holland’s challenges to the validity of the patent. The District Court upheld the jury’s verdict and award of damages and issued a permanent injunction prohibiting sales of Holland’s infringing products. Also served as lead appellate counsel defending the verdict and injunction on appeal before the U.S. Court of Appeals for the Federal Circuit. PCT International, Inc. v. Holland Electronics, LLC
  • Represented the defendant in a $100 million international arbitration proceeding brought by a French multinational seller of luxury goods arising from the alleged breach of a trademark license agreement; obtained a complete defense verdict and an award of fees from a unanimous three-member panel.   • Represented plaintiff Vertiv in a patent infringement and trade secret misappropriation case brought against the client’s former employees and their new company in a case involving computer infrastructure and routing technologies. Case settled shortly after patent claim construction hearing. Vertiv Company v. ZPE
  • Represented the plaintiff in a two-week jury trial involving claims of breach of contract and misrepresentation in connection with the motorized equipment industry. The jury found in the client’s favor and awarded a seven-figure verdict; later represented the client in defense of the verdict on appeal before the Minnesota Court of Appeals.   • Represented the defendant in a two-week jury trial involving claims of alleged price discrimination and misrepresentation. Obtained jury verdict in client’s favor. Harmon Glass Co. v. Hawkeye Auto Glass, Inc.
  • Represented patent holder Graco in a patent infringement suit involving spray pump technology. The case settled on confidential terms following successful early stage motion practice. Graco Minnesota, Inc. v. TTI, Inc.
  • Represented defendant Chem-Treat in a patent infringement and trade secret dispute involving ethanol processing technologies. Obtained summary of non-infringement. U.S. Water Services, Inc. v. Chem-Treat, Inc.
  • Represented the claimant in a false advertising dispute before the National Advertising Division. An arbitration panel issued an order in favor of the client, finding that the challenged advertising statements were unsubstantiated and should be discontinued. Nilfisk-Advance v. Tennant Corp.
  • Represented a Fortune 500 financial services company in an arbitration involving a property valuation dispute; obtained a panel award for the client. U.S. Bank National Ass’n v. 1010 Metrodome Square, LLC
  • Represented patent holder Simmons in a patent infringement case against the world’s largest manufacturer of motorized recreational products; the case settled on confidential terms following a successful claim construction hearing and finding of infringement as a matter of law. Simmons, Inc. v. Bombardier Recreation Products
  • Represented patent holder Transclean in a jury trial involving automotive service technologies and false advertising claims. The jury found in favor of the client on all claims after a two-week trial; later represented the patent holder in the successful defense of the verdict on appeal before the U.S. Court of Appeals for the Federal Circuit.   • Represented defendant Graco in a trademark infringement suit involving competing industrial products. The case settled on confidential terms following defeat of the trademark holder’s motion for summary judgment. Liberty Bell Equipment Corp. v. Graco Minnesota, Inc.
  • Represented the defendant in a case involving alleged infringement of copyrights for test preparation materials; the case settled on confidential terms after the Eighth Circuit Court of Appeals ruled in the client’s favor and reversed grant of permanent injunction. Mulcahy v. Cheetah Learning LLC
  • Represented the defendant in a case involving claims of alleged infringement of copyrights for musical works; the plaintiff dismissed all claims against the client during the discovery phase with no payment by the client. Amstel Music, et al. v. 800 Video, Inc.
  • Served as sole arbitrator in a multimillion-dollar dispute arising from software development and Oracle implementation program. Presided over a week-long arbitration hearing and numerous pre-hearing disputes under the American Arbitration Association’s Complex Commercial Rules.
