Our International Trade group is dedicated to helping clients take advantage of global market opportunities while complying with international trade rules. We advise companies with U.S. and non-U.S. operations on the laws and regulations governing trade in goods, technology and services (exports and imports) and foreign investment. We help increase their access to foreign markets and counter unfair trade practices at home. We represent clients in international trade negotiations and disputes and assist them with trade policy matters.

Growing concerns around the world about the role of forced and child labor in global supply chains have led to numerous regulatory developments impacting international trade and business practices. We work with companies to evaluate and implement effective strategies and compliance mechanisms to address the specific risks related to potential human rights abuses and the use of forced labor in their supply chains. Our team assists companies in understanding the forced labor diligence expectations of U.S. Customs and Border Protection (CBP) and in responding to work release orders (WROs) and audits.&nbsp;

Trade Compliance

In response to national security concerns and foreign policy objectives, the U.S. government has issued stringent, far-reaching regulations to control exports and enforce economic sanctions. These complex and ever-changing U.S. laws regulate the export or reexport of goods, technology and software, and restrict transactions with certain specified individuals, entities and destinations.

We advise clients on day-to-day compliance issues; help develop or upgrade compliance policies and programs and assess the effectiveness of those programs; conduct internal audits; undertake international investigations and prepare voluntary disclosures; and represent clients in government enforcement actions and settlement negotiations. Tariff Mitigation

<a>The use of trade remedies (antidumping, countervailing duty (CVD) and safeguards) to protect home markets has increased. A successful trade remedy case can substantially alter market dynamics by resulting in increased duties or quotas on imports of targeted products. Companies increasingly find themselves involved in trade remedy cases: A company may be forced to defend against an aggressive competitor’s attempt to limit access to an important market or to a crucial input; or a company may be seeking trade remedy relief to protect its market from unfairly priced foreign competition.</a>

To increase their competitive edge, companies must understand how to use trade remedies and how to defend against them. Thompson Hine’s Trade Remedies team is devoted to helping clients understand and take advantage of trade remedy rules, regardless of whether the client wishes to impose or to avoid trade remedies.

We have represented clients in more than 50 antidumping, CVD and safeguard proceedings, which consist of hundreds of separate actions before the U.S. Department of Commerce (Commerce) and the U.S. International Trade Commission (ITC), including original investigations, administrative reviews, changed circumstances reviews, anti-circumvention inquiries, scope inquiries and sunset reviews. We also handle safeguard remedy proceedings and lobby the U.S. Congress and executive branch agencies such as Commerce and the Office of the U.S. Trade Representative (USTR) on trade remedy (and other) issues.

Our International Trade group has significant experience with the full range of customs matters, including compliance, audits and training, prior disclosures, and enforcement actions. One of the senior members of the group has more than 40 years of experience with customs matters and spent eight years with the U.S. Customs Service (CBP’s predecessor) as both a Supervisory Import Specialist and an Operations Officer. Another senior member of our team was involved in shaping customs programs in the early days of the U.S. Department of Homeland Security and had responsibility for managing ports of entry along the U.S.-Canada border. Other senior members of the group have been practicing in the area for more than 20 years. We have strong relationships with CBP officials and a reputation for providing excellent service. We have advised U.S.-based, foreign, and multinational suppliers, retailers and manufacturers across a variety of industries, including aerospace, agriculture, auto parts, chemicals, consumer goods, electronics, food products and textiles.
